The Workforce Innovation and Opportunity Act (WIOA) was enacted on July 22, 2016. Section 458 of WIOA amends Title V of the Rehabilitation Act of 1973 (Rehab Act) by adding new section 511 that limits the ability of employers to pay a subminimum wage to workers with disabilities. The section 511 limitations are effective on July 22nd, 2016.
Essentially, WIOA prohibits employers from paying subminimum wage to someone with disabilities unless the worker has been regularly provided with career counseling, information about self-advocacy, and peer mentoring training opportunities. Also, employers must show documentation proving that they have provided such services as career counseling, transition services, and vocational rehab to workers in the disability community.
